What is the GPSR Responsible Person?
The General Product Safety Regulation — Regulation (EU) 2023/988, applicable since 13 December 2024 — introduced a hard rule in Article 16: a consumer product may not be placed on the EU market unless there is an economic operator established in the Union who is responsible for it. That operator is the "Responsible Person" (RP). It can be an EU manufacturer, an EU importer, an Authorised Representative appointed by written mandate, or — as a last resort — an EU fulfilment service provider.
For a non-EU brand selling direct to EU consumers — through your own site, Amazon, Etsy, TikTok Shop or any other channel — there is usually no EU manufacturer or importer in the chain. What changed under the GPSR
The GPSR replaced the 2001 General Product Safety Directive and was written for the e-commerce era. The headline changes for non-EU sellers:
- The Responsible Person requirement now applies to virtually all consumer products — clothing, furniture, jewellery, homeware, toys, electronics — whether or not they carry a CE mark.
- Distance selling is explicitly covered: offering a product online to EU consumers counts as placing it on the market, so shipping direct from outside the EU does not avoid the rule.
- Traceability on the product: the RP's name and contact details must appear on the product or on its packaging, parcel or an accompanying document, alongside manufacturer details and product identifiers.
- Marketplace enforcement: online platforms must verify RP details before listings go live — which is why Amazon and others now block or suspend listings without a valid EU Responsible Person.
- Incident reporting: accidents and dangerous products must be notified to authorities through the EU Safety Business Gateway.

The GPSR requires the Responsible Person's name and contact details on the product itself, its packaging, or an accompanying document — and marketplaces additionally require the same details in the listing's compliance fields. GPSR Responsible Person for Amazon, TikTok Shop and e-commerce sellers
Marketplaces are where the GPSR bites first, because Article 22 obliges platforms to collect and verify Responsible Person details before a listing goes live. In practice: Amazon requires a valid EU Responsible Person in the compliance section of every listing in scope and suppresses ASINs without one — including for sellers fulfilling from outside the EU. TikTok Shop asks for RP details at product-listing level for its EU markets. Etsy, eBay, Zalando and Kaufland run equivalent checks. What happens without one
Products without a valid EU Responsible Person cannot legally be placed on the market: customs can detain shipments at the border, market surveillance authorities can order products withdrawn, marketplaces suppress listings, and member states impose penalties under their national regimes. For marketplace sellers the practical enforcement is immediate — listings simply do not go live without verified RP details.
